These are the Terms and Conditions of Sale for Grooveliner Limited (grooveliner) that govern the purchase of goods and services.

Definitions

1.1. In these Conditions, certain terms are defined as follows:

Business Day(s): Refers to a day (excluding Saturdays, Sundays, and public holidays) when banks in London are open for business.

Conditions: The terms and conditions outlined in this document, subject to amendments as per clause 14.

Contract: The agreement between Grooveliner Limited and the Customer for the purchase of Goods or Services in accordance with these Conditions.

Customer, you, your: The individual purchasing Goods or Services from Grooveliner Limited.

Event Outside Our Control: As defined in clause 13.

Goods: The goods specified in the Order.

Grooveliner Limited, we, us, our: Refers to Grooveliner Limited, the seller.

Order: The Customer’s request for Goods or Services submitted through the Website.

Services: The services specified in the Order.

Website: Refers to Grooveliner.com or the Grooveliner App.

1.2. In these Conditions, the following rules apply:

1.2.1. Person includes a natural person, corporate or unincorporated body, regardless of legal personality.

1.2.2. Reference to a party includes personal representatives, successors, or permitted assigns.

1.2.3. Phrases introduced by terms like including, include, in particular, or any similar expression are illustrative and do not limit the sense of the preceding words.

1.2.4. Reference to writing or written includes emails.

The Contract

2.1. The Order placed via the Website constitutes an offer to purchase Goods or Services under these Conditions. The Customer is responsible for ensuring the correctness of the Order.

2.2. An email, order confirmation, or electronic acknowledgment of an Order does not constitute legal acceptance. Acceptance occurs when:

(a) Payment is received, and

(b) Goods are dispatched (with dispatch confirmation) or Services are completed.

2.3. Orders are subject to stock availability and validation checks (clause 5). If issues arise, Grooveliner Limited will contact the Customer for resolution.

2.4. Orders are accepted only from and delivered to UK addresses unless otherwise confirmed prior tot the order in writing.

2.5. Fitting services are specific to the booked vehicle and the order placed and must be arranged in advance. 

2.6. Order details are retained in our database, accessible upon request from customer services.

2.7. The Order Confirmation indicates the contracted good and services

Product Information

3.1. Goods and Services match descriptions on the Website, Grooveliner reserves the right to amend product specifications and our website at any time if needed.

3.2. Images are for illustration, and online color representation may vary.

3.3. Weights and sizes are approximate guides.

3.4. Grooveliner is not liable for losses from relying on Website advice.

3.5. Errors in price or description may be corrected by Grooveliner limited, with the option for the Customer to cancel and receive a full refund.

Price Information

4.1. Goods and Services prices are as shown on the Website in Pounds Sterling.

4.2. Goods prices exclude delivery charges, shown during check-out.

4.3. Certain Services may have additional costs for extra work, communicated and payable in advance.

4.4. Prices include applicable VAT, adjusted if the rate changes before delivery.

4.5. Website prices may vary depending on promotions and special offers which are available form time to time

4.6. Special Offers and promotions may not apply online unless specifically stated. All offers are subject to availability.

4.7. Offers cannot be combined, and the most favorable discount applies. Voucher code offers can’t be combined with other promotions. Offers only apply at the time of payment.

Payment Information

5.1. Grooveliner accepts major credit/debit cards registered to UK addresses.

5.2. Other payment methods are not accepted online.

Delivery of Goods

6.1. Delivery details, charges, restrictions, and lead times are outlined on the Website.

6.2. Goods may be delivered in instalments, constituting separate Contracts.

6.3. Delivery dates are approximate, and Grooveliner is not liable for costs due to delays. Delivery responsibility transfers to the Customer upon completion.

6.4. Unsuccessful deliveries prompt various actions, including attempted redelivery, neighbor delivery, or Post Office collection.

6.5. Grooveliner is not liable for delays caused by Events Outside Our Control or insufficient delivery instructions.

6.6. Failure to meet estimated delivery deadlines allows the Customer to cancel and receive a full refund, unless partial delivery significantly reduces value.

Cancellations, Refunds, and Returns

7.1. Customers may return delivered Goods within 28 days for a refund or exchange, subject to the conditions outlined on the Website.

7.2. The right to return doesn’t apply to used products 

7.3. Legal cancellation rights begin on the Dispatch Confirmation date, with deadlines based on Order specifics.

7.4. Fitting Services booking changes can be made up to one working day before the appointment, subject to a late cancellation fee for changes made less than one working day in advance.

7.5. Cancellation of Goods Contracts requires notifying Grooveliner. Cancellation is effective from the date of notice.

7.6. If canceled, Grooveliner will refund the Goods’ price and delivery costs. Refunds occur within specified deadlines.

7.7. Faulty or misdescribed Goods returned under clause 7.1 result in a full refund, including applicable delivery charges.

7.8. Refunds are made to the original payment method.

7.9. Returned Goods must be sent back promptly and securely, with return costs borne by the Customer unless the Goods are faulty.

7.10. Grooveliner may be unable to cancel Orders before dispatch. In such cases, the Customer can return Goods as outlined in their rights.

After-sales Service and Guarantees

8.1. Manufacturer guarantees and service details are provided with Goods or Services. After-sales service is handled by local Grooveliner stores or Garages.

8.2. Warranties are non-transferable, applying only to the original Customer.

8.3. Grooveliner’s guarantees are detailed on the Website.

Complaints and Queries

9.1. Customers with service-related issues can contact Grooveliner for resolution.

9.2. If internal complaints handling fails, customers may refer the complaint to an Alternative Dispute Resolution (ADR) provider or the EU Commission’s Online Dispute Resolution (ODR) Platform.

9.3. Temporary Website restrictions for updates, maintenance, or repairs may occur.

9.4. Grooveliner is not responsible for third-party sites and advises reviewing their terms and conditions.

Safe Shopping Guarantee

10.1. Grooveliner ensures secure online shopping through encrypted server software.

10.2. While efforts are made to protect personal information, complete security cannot be guaranteed. Customers accept inherent online security risks.

10.3. External links lead to external websites with different Privacy Policies.

Security certificates

This Website has a Secure Server Digital Certificate confirming its legitimacy and secure data transmission. Operated by Grooveliner Limited.

Liability

11.1. Grooveliner is liable for foreseeable losses resulting from breach or negligence but not for unforeseeable losses.

11.2. Goods and Services are provided for domestic use, and Grooveliner is not liable for commercial or resale purposes.

11.3. Grooveliner’s liability is not excluded for death, personal injury, fraud, breach of Consumer Rights Act terms, or defective products under the Consumer Protection Act 1987.

Variation

Grooveliner may amend these Conditions. The Conditions in force at the time of Order apply.

Communications between us

Communications are in writing, with notices sent to the address specified by the Customer. Deemed received per agreed methods.

Other Important Terms

12.1. Grooveliner may transfer rights and obligations under the Contract.

12.2. Customer transfers require written agreement.

12.3. The Contract is between the Customer and Grooveliner, with no third-party rights.

12.4. Each paragraph operates separately, with unlawful or unenforceable parts not affecting others.

12.5. Grooveliner’s failure to enforce rights does not waive them.

12.6. English law governs the Contract, with the courts of England and Wales having non-exclusive jurisdiction.

Events Outside Our Control

13. Grooveliner is not liable for failure or delay in performance due to Events Outside Our Control, including but not limited to strikes, natural disasters, or terrorism.
